EAU CLAIRE, Wis. (WEAU) – Three teenagers have been charged after allegedly attacking the owner/bouncer of El Patio on Halloween night for refusing them entry.
According to online court records, Terrell Conway, 17, was charged with felony battery as an accessory to a crime and disorderly conduct as an accessory to a crime.
Justin Davis, 19, was charged with felony battery as an accessory to a crime, felony bail jumping and disorderly conduct as an accessory to a crime.
Eugene Collins Jr., 17, was charged with felony battery as an accessory to a crime and disorderly conduct as an accessory to a crime.
According to a criminal complaint, the victim said that that night a group of African Americans tried to enter El Patio and he turned them away. They were escorted back and he was attacked. One of the attackers hit him in the back with a baseball bat while others beat him. The group left before the police arrived.
On November 1, an anonymous caller had information about the fight that took place at El Patio. They identified two minors involved in the fight. The two juveniles, IB and TB, said they had to leave town because of the incident and were going to take a bus to Milwaukee.
Officers located IB and TB and took them into custody at the McDonalds while they waited for the bus.
Officers then took IB and TB to Mayo Hospital for medical examination as they were both complaining of pain.
At the hospital, TB and the police officer were waiting for him to be treated when an uninvolved patient asked the officer if he knew about the fight that had taken place. The officer said he did not know any details. TB told the patient that a bouncer had refused to let several young people into a bar. TB said the bouncer called them racial slurs. TB said something like, “I just grabbed the thing closest to me.” »
The officer said he reminded TB several times that he was not going to discuss the matter with him. TB asked if he was here because of the bat case and the officer replied that he believed it was true but didn’t know the details of the case.
IB and TB were medically cleared by staff. TB refused to speak after the incident.
IB agreed to speak to the officers. IB told the victim that his aunt was at El Patio and the victim refused him entry to the bar/restaurant. IB asked to use the toilet and the victim replied that she could only go in if she paid something. IB said she would buy a burrito. IB attempted to enter and the victim grabbed her and pushed her to the ground. Camera footage shows this incident.
The officer described the altercation as it appeared on the camera footage. The victim swung towards IB and IB rolled back. The camera footage shows IB pushing the door closed. The victim opened the door and appeared to push IB away. IB punched the victim in the face. The victim responded by hugging IB and trying to push him away. TB saw this and tried to intervene. TB punched the victim. The victim tried to catch tuberculosis. TB returned and the victim tried to get rid of TB. IB and another individual, a white man, later identified as Davis, approached the victim as if to attack him. The victim adopted a defensive position to protect himself. Davis attempted to punch the victim. He tried to push Davis away. TB, IB, Davis and another individual, who was wearing a red hooded sweatshirt and later identified as Collins Jr., began attacking the victim. TB left the camera’s view and returned with a baseball bat. Collins, Davis, TB and IB all threw closed punches at the victim. Collins briefly held the victim in a headlock while others punched him.
A fifth individual, later identified as Conway, also approached the victim. Conway appeared to try to move Davis to get a better angle to strike the victim. Conway backed away briefly. Once he fell to the ground, Conway rushed inside. Conway then backed away to avoid being hit by a baseball bat wielded by TB. TB swung the bat at the victim while he was on the ground.
At that point, four of the five individuals involved in the victim’s attack began to leave the scene. Davis continued to punch the victim as he tried to get up.
The victim suffered several injuries as a result of the attack, including several broken teeth, a large bump on his cheekbone and a baseball bat-sized bruise on his back.
Five people were involved but only three were charged.
Conway has a first appearance scheduled for Dec. 9.
Davis was given a $100 cash bond with orders not to contact El Patio, the victim and his co-defendants. A hearing is scheduled for November 30.
Collins Jr. was released on a $5,000 signature bond with orders not to contact El Patio, the victim and his co-defendants. A hearing is scheduled for December 21.
