Judge William Sullivan could decide whether the case can continue on Monday or whether he could rule later in writing, criminal defense lawyer Elyse Hershon told the BBC.
And how the prosecutor’s office wants to proceed could be determined before Monday’s hearing, during it or even a few days afterward, she said.
“All three first-degree murder charges are still pending; they still hang over Lindsay Clancy’s head unless the prosecutor says otherwise,” Hershon said.
Historically, Cruz, the prosecutor, has made comments and announcements about the case during news conferences after the trial ended. It could happen again this week, she predicts.
It’s also likely, Hershon said, that Judge Sullivan will push attorneys for both sides to put a trial date on the calendar during Monday’s hearing.
“That doesn’t mean it’s definitely going to be a jury trial, but (they’ll want to) put something in the books, set those dates. It takes a lot of time. It’s four, five, six weeks of the court calendar; it’s hard to fit in at the last minute,” she adds.
“I would expect them to block time while they make all these motions and the DA’s office figures out what they want to do.”
