Officers described signs they believed indicated impairment
Ringside News said it obtained nine pages of law enforcement documents filed in Orange County. Her account of those documents describes what officers said they observed after Flora was taken to the Orange County Sheriff’s Office DUI testing center.
Officers noted bloodshot, glassy eyes, a red face and the odor of alcohol on his breath. They described her speech as slow and difficult, while noting that she was cooperative during the initial observation period.
When she was escorted to the testing room, officers reported that she was walking slowly and swaying from side to side.

According to the outlet’s account of the testing records, Flora initially refused to provide a breath sample. The officers explained to him the consequences of refusing and started the testing equipment to give him the opportunity to continue.
Two rounds of testing produced no valid breath samples
The first sequence of tests ran from 3:06 a.m. to 3:17 a.m. Two attempts were marked “DK,” which the report identified as meaning no sample was provided.
Flora asked to speak to an attorney during the process, according to the officer’s account. Before the refusal was finalized, she requested another opportunity to take the test.

Officers restarted the equipment. Two other attempts, between 3:19 a.m. and 3:31 a.m., also failed to produce valid samples. Police alleged that Flora continued to speak during periods when she was supposed to provide a sample.
The police officer recorded a refusal at the end of this second sequence. The documents described do not contain any measured blood alcohol concentrations.
