LAS VEGAS (FOX5) — The Canadian man accused of stealing and injuring a pink flamingo on the Las Vegas Strip was found guilty by a jury Monday.
Mitchell Fairbarn, 34, was in court and appeared impassive as the court clerk read the guilty verdict on the misdemeanor and felony counts. His wife, friend and brother were also seen in the courtroom.
Fairbarn made no comment as he left the Regional Justice Center.
The jury, made up of eight women and six men, deliberated for several hours. The two designated alternates were not necessary.
Fairbarn faced two counts of animal cruelty, with prosecutors noting in their closing arguments that one stems from what happened in the habitat while the second relates to what happened in the hotel.

He initially faced four charges before prosecutors decided to focus the trial solely on what happened to Peachy in March.
Prosecutors Haley Willming and Alex Chen opened with surveillance video, photos and Snapchat clips showing Fairbarn smiling, laughing and grabbing the flamingo by the neck with two friends.

The videos also showed Fairbarn walking toward the elevators and the flamingo, identified as Peachy, alone in a hallway.
Fairbarn testified that he took Peachy as a “silly joke” after drinking 30 to 40 beers, denying malicious intent to harm or kill the bird.
Fairbarn will be sentenced on December 1. Animal advocates told FOX5 they welcome the jury’s decision.
