NEW YORK — New York City must provide information about homeless shelter residents sought by federal immigration authorities, a federal judge ruled Friday.
In a 12-page order, the district judge Lewis Kaplan forced the New York City mayor’s administration Zohran Mamdani to comply with a subpoena from U.S. Immigration and Customs Enforcement. The subpoena seeks information including the names and dates of birth of homeless men living in a Bronx shelter.
According to the order, the federal government is conducting an investigation to determine whether anyone living in the shelter is in the country illegally and could be deported. As part of its investigation, federal authorities are tailoring their request to residents accused of certain violent crimes and have agreed to the appointment of a special master to sort the list of names accordingly.
“In light of the agency’s consent to the use of a special master and deferring to the agency’s assessment that the records are relevant to its legitimate investigation, the Court therefore concludes that the subpoena concerns a material and relevant matter for the enforcement of federal immigration laws,” Kaplan wrote.
